Delhi Court Orders Release of AAP MLA Amanatullah Khan
A Delhi court granted the release of Aam Aadmi Party (AAP) MLA Amanatullah Khan from judicial prison in connection with a money laundering case involving the Delhi Waqf Board. The judge cited a lack of prosecutorial penalty as the rationale for his release.
Court Decision
Special Judge Jitendra Singh of Rouse Avenue Court ordered Khan’s release on a Rs 1 lakh bail bond. The court ruled that, while there was sufficient evidence to charge Khan, no prosecution sanction had been obtained.
Case Background:
The Enforcement Directorate (ED) case against Khan concerns alleged violations during his time as chairman of the Delhi Waqf Board from 2016 to 2021. The ED claimed that Khan fraudulently appointed board members, resulting in a loss to the exchequer, and that Khan’s agents laundered Rs 36 crore in properties.
On October 29, the ED filed a supplemental chargesheet against Khan and his wife, Maryam Siddiqui. But the court didn’t accept the charge sheet because the lawyer didn’t have enough grounds for the case.
Khan was caught on September 2 after agents searched his home. The courts have held him for two months. According to the ED, Khan lied when he was being questioned. This is why they need to do more work under the SAML Act.
Why did the court set Amanatullah Khan free? That shows how hard it was for the ED to bring the case to court. Khan was set free because there wasn’t enough proof against him for the government to charge him.
